Purpose and legal basis of data management

Kultmisszió Kft. handles the personal data provided during the order for the purpose of fulfilling the order and issuing and storing the invoice. The legal basis for data management is the fulfillment of the contract with regard to the fulfillment of the order, and the obligation based on the legislation on the issuance and storage of the accounting receipt (invoice) (§ 165 (1) and § 169 (2) of the Accounting Act) with regard to the issuance of the invoice. The provision of the personal data provided during the order is a prerequisite for the conclusion of the contract, since Kultmisszió Kft. cannot fulfill the order without providing the personal data required for the order, and Kultmisszió Kft. cannot issue the accounting receipt (invoice) without providing the billing data.

Recipients of personal data

The personal data provided for the purpose of the order are provided by the service providers who deliver the ordered product:

  • Csomagpiac Kft. (headquarters: 2100 Gödöllő, Németh László u. 1/b company registration number: 13-09-144907); it can be known by persons acting on its behalf or on its behalf, or in its employ;
  • accountant of Kultmisszió Kft
  • the National Tax and Customs Office can find out if the accounting document (invoice) contains sales tax exceeding HUF 100,000.

Kultmisszió Kft. will not forward the personal data provided during the order to any other person.

    Duration of data management

    Kultmisszió Kft. processes the personal data provided for the purpose of fulfilling the order for 365 days after the fulfillment of the order.

    Kultmisszió Kft. keeps the personal data provided for the purpose of issuing the accounting certificate (invoice) until the 8th year from the issuance of the accounting certificate and destroys it in January of the year following the expiration of the 8th year in order to fulfill the retention obligation based on law.

    Modification of the data management information

    Kultmisszió Kft. can modify this data management information at any time. The amended data management information must be applied when it is published by Kultmisszió Kft. on its website. Your order is governed by the data management information in force at the time of placing the order.

    Your rights related to data management

    Right of access

    You have the right to receive feedback from Kultmisszió Kft. regarding whether Kultmisszió Kft. manages your personal data. If Kultmisszió Kft. manages your personal data, you are entitled to access the following information: (i) the purposes of data management; (ii) categories of personal data concerned; (iii) recipients or future recipients of processed personal data; (iv) the planned period of storage of personal data or the criteria for determining the period; (v) your right to correct, delete or restrict the processing of your personal data and your right to object to the processing of your personal data; (vi) the right to submit a complaint to the National Data Protection and Freedom of Information Authority; (vii) information about the source of the personal data if the personal data was not collected directly from you; and (viii) the fact of automated decision-making, at least comprehensible information about the applied logic and the significance of the processing of personal data and the expected consequences for you. Kultmisszió Kft. provides you with a copy of the processed personal data.

    Right to rectification

    You have the right to ask Kultmisszió Kft. to correct your inaccurate personal data or supplement your incomplete personal data without undue delay.

    Right to erasure

    Kultmissió Kft. deletes your personal data without undue delay at your request. In other cases, Kultmisszió Kft. will delete your personal data without undue delay if (i) Kultmisszió Kft. does not need the personal data for the purpose for which it was collected or managed, (ii) you have withdrawn your consent (consent-based in the case of data processing) and there is no other legal basis for data processing, (iii) you object to data processing for reasons related to your own situation and there is no overriding legal reason for data processing or you object to data processing for the purpose of direct business acquisition, (iv) your personal data was processed illegally .

    Kultmisszió Kft. does not delete personal data if the data processing is for (i) the exercise of the right to freedom of expression and information, (ii) the fulfillment of a legal obligation applicable to Kultmisszió Kft., which prescribes the processing of personal data, or in the public interest or for the purpose of carrying out a task within the framework of the exercise of the public authority granted to Kultmisszió Kft., (iii) on the basis of the public interest in the field of public health, (iv) for the purpose of archiving in the public interest, for scientific and historical research purposes or for statistical purposes (if the right to erasure would probably be impossible would do or would seriously jeopardize this data management), or (v) necessary for the submission, enforcement or defense of legal claims.

    If Kultmisszió Kft. has made the personal data public and is obliged to delete it, it will do everything that is expected of it in order to inform the personal data handlers that you have requested from them the deletion of the links pointing to the given personal data or the copy or duplicate of the personal data.

    Right to restriction of data processing

    You can ask Kultmisszió Kft. to limit data processing. With the exception of the storage of personal data, Kultmisszió Kft. may only process it with your consent or to submit, enforce or defend legal claims or to protect the rights of another person or in the important public interest of the European Union or a member state.

    You can request the restriction of the processing of your personal data if (i) you dispute the accuracy of the personal data, (ii) the data processing is illegal, you oppose the deletion of the personal data, (iii) Kultmisszió Kft. does not need the personal data for data processing purposes, however, you require the restriction of personal data in order to present, enforce or defend legal claims, or (iv) you object to data processing for reasons related to your own situation. Kultmisszió Kft. informs you about the lifting of the restrictions on data management before the lifting.

    Objection to the processing of personal data

    You can object to data processing for reasons related to your own situation, if the processing of personal data is necessary to enforce the legitimate interests of Kultmisszió Kft. or a third party.

    You can object to data processing at any time if personal data is processed for direct business purposes. Kultmisszió Kft. cannot process personal data if you object to the processing of personal data.

    Right to data portability

    You can request that the personal data provided to the data controller be received in a segmented, widely used, machine-readable format if the personal data processing is based on consent and the data processing is automated.

    Kultmisszió Kft. informs you that your personal data is not handled in an automated way, so you cannot exercise your right to data portability at Kultmisszió Kft.
